1. Acceptance of Terms
By accessing or using VinoBloc("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and VinoBloc.
2. Description of Service
VinoBloc provides vineyard, orchard, and greenhouse management software including labor tracking, compliance management, scouting, and analytics tools. The Service is provided on a subscription basis.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. You must provide accurate and complete information when creating your account.
4. Subscription and Payment
Access to VinoBloc requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are provided at our discretion.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: violate any applicable laws or regulations; upload malicious code; attempt to gain unauthorized access to the Service; use the Service to transmit spam or harmful content; reverse engineer or copy the Service.
6. Your Data
You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited license to store, process, and display your data solely to provide the Service. We will not sell your data to third parties. Upon account termination, you may request export of your data within 30 days.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by VinoBloc and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VINOBLOC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
